Information Medicine BV respects the privacy of its website visitors, in particular their rights with regard to the automatic processing of personal data.

This privacy statement describes what personal information we collect about you when you use our website and/ or purchase our products. We also explain how we will protect and respect your personal information and privacy as a user of our website.

a)  The personal data you provide to us will be treated with the greatest possible care. We therefore strictly adhere to the General Data Protection Regulation (“GDPR”) and other applicable privacy laws.

2. Definitions

a) Website (hereinafter: “website”) includes all (future) URL’s owned and operated by Information Medicine BV. Current website: www.informationmedicine.org

b)   Controller (hereinafter: “Information Medicine BV”): Responsible for the processing of personal data: Information Medicine BV, located at Bisschopsweg 2, 3732 HW De Bilt, Chamber of Commerce number: 80352693.

3. Access to our website

Access to and use of our website is strictly personal. You refrain from using the data and information of our website for your own commercial, political or advertising purposes.

4. Content of our website

All brands, images, texts, comments, illustrations (animated) images, graphic files,video images, sounds and all technical applications that can be used to make our website(s) work. In short, all components used on our website(s) are protected by the laws of intellectual property. Any reproduction, repetition, use or modification, by any means whatsoever, of all or part of it, including technical applications, without the prior written consent of the person in charge, is strictly prohibited. The fact that Information Medicine BV is not allowed to take immediate action against an infringement cannot be regarded as tacit consent, nor as a waiver of any right to prosecute the infringing party.

5. Management of our website(s)

In order to ensure the proper management of our website(s), Information Medicine BV may at any time:

a)   suspend, interrupt, reduce or deny access to the website for a certain category of visitors;
b)   remove all information that may disrupt the functioning of the website or that conflicts with national or international legislation or is contrary to internet etiquette;
c)   make the website temporarily unavailable to perform updates.

6. Responsibilities

a)   Information Medicine BV is not liable for any malfunctions, difficulties or interruptions in the functioning of our website(s), as a result of which our website(s) or one of it’s functionalities is (temporarily) inaccessible.
b)   You are responsible for the way you connect to our website. You must take all appropriate measures to protect your equipment and data against threats such as virus attacks on the Internet.
c)   Information Medicine BV is not liable for any legal proceedings brought against you:
i. due to the use of our website or services accessible
ii. for violating the terms of this privacy policy

d)   Information Medicine BV is not liable for any damage suffered to you or third parties or your equipment as a result of your connection to or use of our website(s).
e)   If Information Medicine BV is involved in a dispute because of your (mis)use of our website(s), we have the right to (re)claim all subsequent damage from you.

7. Collection of data

a)   Your personal data will be collected by Information Medicine BV and (an) external processor(s).
b)   Personal data means any information relating to an identified or identifiable natural person (‘data subject’).
c)   An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.
d)   The personal data that are collected on the website are mainly used by Information Medicine BV in to:
i. performance of an agreement between you and us, e.g. when you take out a subscription or buy a product from us;
ii. if applicable in order to process your orders;
iii. if the processing is necessary for the purpose of our legitimate interests, e.g. (direct) marketing, (promotional) mailings, performing market research and improving our services;
iv. and if the processing is necessary for compliance with a legal obligation.
e)   The data retention period, for keeping data depends on the situation:
i. Active accounts: as long as an account is active, all personal data is stored in the consumer’s personal dashboard.
ii. Inactive accounts: as long as payments are made for an account, all personal data is retained, even if the account is not actively used.
iii. Canceled accounts: once an account has been cancelled, all data is retained for 30 days. After this period, only those data that are necessary for accounting purposes such as tax returns will be retained.
iv. Outstanding order: this is an order where something has been placed in the shopping cart but has not yet been paid for: the contents of the shopping cart are kept for 48 hours. The consumer receives an email alerting him that there is still something in the shopping cart.
v. Failed orders: this is an order that was not completed correctly, for example because the payment failed. This data is kept for 24 hours.
vi. Canceled orders: this is an order that was completed correctly, but later canceled by the consumer. This data is stored in the consumer’s personal dashboard for 30 days.
vii. Completed order: as long as an account is active, all details of completed orders are saved by means of an invoice in the consumer’s personal dashboard.
viii. Stripe data: as long as an account is active, all payment details are stored and included in the personal dashboard of the consumer through invoices. Other payment details are kept as long as this is necessary for accounting purposes such as tax returns.

8. Third parties

We may provide your personal data to third parties if this is necessary. We only provide your personal data to third parties who have committed themselves to comply with applicable privacy legislation and that, if provided for by law, with whom we have entered into a data processing agreement.

We may share your personal data with the following categories of third parties:

a)  Payment system providers that process your payments for products.
b)  Delivery companies that we use to deliver or collect your orders from you.
c)  Third parties we have hired to assist us in conducting promotional and marketing activities and provide technical assistance and support.

We will also disclose your personal information to third parties:

a)   If we are required by law to disclose or share your personal information in order to comply with a legal obligation or a lawful request from a legal or regulatory authority.
b)   To respond to any claims and to establish, exercise or defend our legal rights.

We will always ensure that any third parties with whom we share your personal information are subject to privacy and security obligations in accordance with this privacy statement and applicable law. These third parties are themselves subject to the General Data Protection Regulation (GDPR).

9. Your rights with regard to information

Pursuant to Article 13(2)(b) of the GDPR, each data subject has the right to information about and access to their personal data, to rectification, erasure and restriction of the processing of their personal data, as well as the right to object to the processing and the right to data portability.

a)   You have the right to request us to:
i. provide you with a copy of any personal information we hold about you;
ii. update your personal information that is out of date or inaccurate;
iii. delete any personal data we hold on you;
iv. restrict the way we process your personal data;
v. consider any valid objections you may have to our use of your personal data; or
vi. provide your personal data to an external service provider.

b)   You have the right to ask us or third parties to stop sending you marketing communications at any time. You can do this by opening an e-mail that you have received from us and clicking on ‘unsubscribe’ which you can find at the bottom of the e-mail.

c)   You may also email us at contact@informationmedicine.org and request that we remove your email address from our database. This can take up to 5 business days to complete.

d)   If you choose to opt-out of receiving marketing communications from us, you will continue to receive emails about placed orders, if applicable. This includes emails such as order confirmation, order shipment confirmation, product/service experience (i.e. product review), cart abandonment emails, and information related to returns such as exchange or refund confirmations. This is a legitimate interest for our business and for you as our customer.

e)    Finally, you have the right to submit a complaint to the Dutch Data Protection Authority via www.autoriteitpersoonsgegevens.nl/en.

10. Legal obligations

a)  In the event of violation of any law or regulation, of which a visitor is suspected and for which the authorities need the personal data collected by Information Medicine BV, these will be provided to them after an explicit and motivated request from those authorities, after which these personal data are no longer protected by the provisions of this Privacy Policy.

11. Collected data and commercial offers

a)  Under GDPR law, we have the option to contact you if we believe that you have demonstrated a legitimate interest in our company, services and products. For example, if a customer has purchased a product from us, has expressed an interest in the services, products and brands or has a professional interest in the services, products and brands we sell, we may therefore contact them in the knowledge that they have a legitimate interest in our company/service.

b)   If you do not wish to receive these commercial offers (anymore), please send us an email to the following address: contact@informationmedicine.org.

c)   Your personal data will not be used for commercial purposes by our partners.

d)   If during your visit to our website you come across personal data of other data subjects, you must refrain from collection, unauthorized use or any other act that infringes the privacy of the data subject(s). Information Medicine BV is not responsible in these circumstances.

12. Data retention

The collected data will be used and kept for the duration determined by law.

13. Cookies

When you first visit our website(s), you have the option to select your cookie preferences. You have the choice to accept all cookies, including performance and marketing cookies, or you can only accept the cookies that are strictly necessary for the website to work properly.

14. Image and products offered

You cannot derive any rights from the images that accompany any product offered on our website.

15. Applicable law

Dutch law applies to these conditions. The court in the district where Information Medicine BV has its registered office has exclusive jurisdiction if a dispute about these terms and conditions should arise, unless a legal exception applies.
