Welcome to the Information Medicine platform! Our platform can be accessed through our website at www.informationmedicine.org.

These are our General Terms and Conditions. They always apply when you use our services or purchase products offered through our website. They contain important information for you as a consumer.  Please read them carefully before using our website. Your access to and use of our services, products and content is conditioned on your acceptance and compliance with these terms. If you do not want
to fully and irrevocably agree to these terms, you may not use our services, products or content.

We can understand that you don’t feel like reading 9 pages of terms and conditions before you use our website. Here is a short overview of what you can find in these terms:

  1. Definitions: different ways we and other things are referred to.
  2. General: That these terms always apply, but they don’t exclude any legal rights you may have.
  3. Prices and information: Everything you need to know about prices of everything we offer, what is included in those prices, and which payment methods we accept.     Short version: If you choose to return a product, you pay for the return cost. De costs for the product itself and de delivery costs will be reimbursed. You are not obligated to give a reason for returning or cancelling something, but we do have a right to ask for a reason.
  5. Complaints, complements and feedback: how to communicate with us in case you are happy or disappointed or just want to talk. Also what your legal rights are in this matter.
  6. Warranty disclaimers and limitation of liability: states limits to our responsibility and liability. Also states that websites don’t always work and that this can be beyond our control.
  7. Force Majeure: we are not responsible for breach of contract due to any causes beyond our control.
  8. Final provision and jurisdiction: which laws are applicable. In short it means that nothing we state in any of our documents supersedes any law. It also means that anything that is not stated in these terms (or our other term) might still be applicable by law.

1. Definitions

1.1. Information Medicine BV: all references to the ‘company’, ‘Information Medicine’, Information Medicine platform”, ‘us’, ‘our’, ‘we’.
1.2. Consumer: all references to ‘you’, ‘your’, ‘he’, ‘she’, ‘they’ the ‘user’ or the ‘customer’: In the context of these general terms and conditions, a consumer includes both a natural person and a company.
1.3. Natural person: any natural person who acts for purposes that fall outside his trade, business, craft or profession, who enters into an agreement with Information Medicine BV and/or is registered on our website(s).
1.4. Company: any natural or legal person who pursues an economic goal in a sustainable manner, as well as its associations, who enters into an agreement with Information Medicine BV and/or is registered on our website(s).
1.5. Website: all references to the ‘website’ include all (future) URLs owned by Information Medicine BV.
1.6. Agreement: any arrangement or agreement between Information Medicine BV and the consumer of which these General Terms & Conditions form an integral part.
1.7. Terms: these General Terms & Conditions.
1.8. Communication: includes communication by (mobile) telephone, e-mail, through our website and postal or courier service.
1.9. Subscription: a subscription that gives access to those parts of the content of the Information Medicine platform that are included with that specific subscription.
1.10. Products: goods offered by or purchased from Information Medicine BV.
1.11. Digital content: data produced and delivered in digital form.

2. General

2.1. These terms and conditions apply to every agreement between Information Medicine BV and the consumer.
2.2. Changes and additions to this agreement are only valid if they have been jointly agreed on, in writing, by both parties in a separate agreement.
2.3. Under applicable law, you may have certain rights that cannot be limited by contract. These terms are in no way intended to limit those rights.
2.4. We reserve the right to change these terms at any time. Such changes will become effective when they are posted on the website.
2.5. The effective date stated at the bottom of this document indicates when these terms were last amended.
2.6. For notices by email, the date of receipt shall be deemed to be the date on which such notice is sent.

3. Prices an information

3.1. Subscriptions

a) Information Medicine BV offers its services as a paid subscription. A description of the features and prices of the different subscriptions is available on our website.
b) Subscription fees must be paid to Information Medicine BV prior to the subscription period.
c) Depending on the type of subscription, Information Medicine BV will charge the amount due for the next term by direct debit after the first payment.

3.2. Subscription prices, duration, termination and renewal

a) All prices and other information on the website and on other communications from Information Medicine BV are subject to obvious programming and typing errors.
b) Your subscription is strictly personal. It is prohibited to let a third party use your account.
c) All information you provide or have provided when creating your account is accurate, complete and up to date. You will update your account information when necessary.
d) You agree to keep your username and password confidential. Information Medicine BV is not liable for any misuse of your username, password or other means of identifying yourself when using our services, products or content. Therefore, Information Medicine BV can assume that if a person logs into the website under your username, it is you. If you
suspect that any of your website identifiers have been misused, you should immediately report this to Information Medicine at contact@informationmedicine.org.
e) We offer subscriptions for different periods. For an up-to-date overview of our subscriptions, we refer you to our website.
f) All subscriptions are automatically renewed for the same period as the initial subscription. Information about your subscription can be found in your account.
g) You can cancel the renewal of your subscription at any time through your account or by contacting our customer service via email: contact@informationmedicine.org
h) If you have purchased a subscription through an App Provider, you must also cancel your subscription directly with that App Provider.
i) You will not receive a refund for the fees already paid for your current subscription period, therefor you subscription will stay active until the end of that subscription period.

3.3. Price changes

a) Information Medicine BV reserves the right to change the pricing terms for subscriptions at any time. We will provide you with reasonable notice of such changes.
b) Changes to the pricing terms are not retroactive and will only apply to subscription renewals after such changed pricing terms have been communicated to you.
c) Price changes will take effect at the start of the next subscription period following the date of the price change.
d) Subject to applicable law, by continuing to use the Information Medicine Service after the price change takes effect, you have accepted the new price. If you do not agree with the changes to Information Medicine BV’s pricing terms, you may choose not to renew your subscription.

3.4. Payment methods

a) All purchases must be paid in advance.
b) You will receive a confirmation email after we have confirmed payment for your order.
c) We accept MasterCard, Visa, Delta, Maestro, Solo, iDeal and PayPal.
d) To ensure that your credit, debit or charge card is not used without your consent, we can validate your name, address and other personal information you provide during the ordering process against appropriate third-party databases.
e) All information provided by you will be treated securely and strictly in accordance with the Data Protection Act 1998.

3.5. VAT, taxes and other fees

a) Unless otherwise agreed or indicated, all rates include VAT.
b) Taxes are calculated based on the shipping destination and specified on the order summary page and on your invoice.
c) Tax rates are based on the rates in effect at the time of your charge. These amounts may change over time with local tax requirements in your country, state, area or even city. Any changes in tax rates will be applied automatically based on the account information you provide.
d) All applicable sales taxes, other levies (including bank charges), taxes and import and export duties, are exclusive.
e) We cannot be held responsible or liable for any taxes, custom duties, tariffs, quarantine charges or storage charges for packages determined by your local customs office. These costs are separate from your shipping costs and are charged directly by the executing agency.
f) Each country has different laws and regulations about buying products from other countries. Before placing your order, please familiarize yourself with your local customs laws regarding the shipping of dietary supplements a.o. it is your responsibility to know what is legal in your country and what is not. We always ship discreetly and in a way that best assists you in receiving your order. If you have any questions about international orders, please contact your local customs office.
g) No refunds will be given for items seized at your local customs office or not delivered unless they are returned to us.

3.6. Order and shipping conformation

a) You will receive an email confirmation once your order has been successfully placed and paid for, including your order number and shipping method.
b) Please make sure your shipping address is correct as we are unable to divert goods once they are on their way to you.
c) Once your order is ready to ship, you will receive a shipping confirmation email with your tracking information, if applicable.

3.7. Delivery Terms

a) Information Medicine BV ships products every business day – Monday to Friday, excluding holidays. All orders are processed and shipped within 48 hours of placing your order.
b) If there is a problem with the processing of your order or with the availability of the selected goods, our customer service will inform you of the expected delivery date within 28 working days of your transaction with us. Please allow extra time (details on request) for the delivery of special orders.
c) If you have any questions about delivery, please contact our customer service (contact@informationmedicine.org).
d) Delivery charges are subject to change without notice. For current rates see 3.8.
e) If you live in a remote area, there may be additional shipping charges. If this is the case, we will contact you prior to shipment.
f) We cannot be held liable for consequential damages caused by late delivery or non-delivery by the carrier designated by the company. In such cases, the liability is limited to the value of those items, which are shown not to have been received by the customer.

3.8. General shipping time estimates by location

a) Standard courier options (domestic): 1-7 business days
b) Standard courier options (international) 7-30 business days
c) Expedited carrier options (domestic): 1-2 business days
d) Expedited carrier options (international): 4-12 business days

3.9. Shipping costs

a) Shipping within the Netherlands between €4 and €15
b) Shipping within the EU between € 4and €15
c) Shipping outside the EU between €10 and €26

3.10. Late Payment

a) You are in breach of your obligations if you do not pay before or on the payment term. If you have not paid after two or more payment reminders, Information Medicine BV may terminate your subscription.
b) Despite the termination, a subscription fee is due until the end of the term of that subscription period. If you do not pay on time (even if Information Medicine BV cannot collect the amount owed from you), Information Medicine BV can (temporarily) deny you access to our services or a part thereof.
c) Information Medicine BV may charge the legally permitted collection costs and/or transfer the claim to a collection agency.

3.11. Other terms

a) Any data charges you incur for or through the use of our services are at your own expense.
b) Information Medicine advises to use our services as much as possible through (free) WIFI networks.
c) Vouchers or other discount codes issued by Information Medicine can never be exchanged for cash. Discounts can only be used for the purchase of a subscription or additional products offered through the Information Medicine Website.
d) Because our services and products evolve over time, we may, at our sole discretion, change or discontinue all or any part of our services, products and content at any time without notice.

4. Right of withdrawal

4.1. For products

a) The consumer can dissolve an agreement with regard to the purchase of a product during a reflection period of at least 14 days without stating reasons. Information Medicine BV may ask the consumer for the reason for withdrawal, but not oblige him to state the  reason(s).
b) The reflection period referred to in the previous paragraph starts on the day after the consumer, or a third party designated in advance by the consumer, who is not the carrier, has received the product, or:
i. If the consumer has ordered several products in the same order: the day on which the consumer, or a third party designated by him, has received the last product. Provided it has clearly informed the consumer about this prior to the ordering process, The Information Medicine BV may refuse an order for several products with different delivery times.
ii. If the delivery of a product consists of several shipments or parts: the day on which the consumer, or a third party designated by him, received the last shipment or the last part.
iii. In the case of agreements for regular delivery of products during a certain period: the day on which the consumer, or a third party designated by him, has received the first product.

4.2. For services and digital content not provided on a tangible medium

a) The consumer can dissolve a service agreement and an agreement for the supply of digital content that has not been delivered on a tangible medium for a minimum of 14 days without stating reasons. Information Medicine BV may ask the consumer for the reason for withdrawal, but not oblige him to state the reason(s).
b) The reflection period referred to in the previous paragraph commences on the day after the conclusion of the agreement.
c) For taking out a subscription, this means that the consumer can use the subscription for 14 days from the day of taking out the subscription and within these 14 days has the right to cancel the subscription without giving any reason.
i. If the subscription is canceled within 14 days, the full installment amount paid for that subscription will be refunded.

4.3. Extended cooling-off period for products, services and digital content that is not delivered on a material medium in the event of not informing about the right of withdrawal

a) If Information Medicine BV has not provided the consumer with the legally required information about the right of withdrawal or the model form for withdrawal, the reflection period will expire twelve months after the end of the original agreement, determined in accordance with the reflection period in the previous paragraphs of this article.
b) If Information Medicine BV has provided the consumer with the information referred to in the previous paragraph within twelve months after the commencement date of the original cooling-off period, the cooling-off period will expire 14 days after the day on which the consumer received that information.

4.4. Obligations of the consumer during the reflection period

a) During the reflection period, the consumer will handle the product and the packaging with care. He will only unpack or use the product to the extent necessary to determine the nature, characteristics and function of the product. The basic principle here is that the consumer may only handle and inspect the product as he would be allowed to do in a
store.
b) The consumer is only liable for depreciation of the product that is the result of a way of handling the product that goes beyond what is permitted in paragraph a).
c) The consumer is not liable for depreciation of the product if Information Medicine BV has not provided him with all legally required information about his right of withdrawal.

4.5. Return shipping costs

a) As soon as possible, but within 14 days from the day following the notification referred to in paragraph 4.1-4.3, the consumer returns the product or hands it over to (an authorized representative of) Information Medicine BV. This is not necessary if Information Medicine BV has offered to collect the product itself. The consumer has in any case observed the
return period if he returns the product before the reflection period has expired.
b) The consumer returns the product with all accessories supplied, if reasonably possible in its original condition and packaging, and in accordance with our reasonable and clear instructions.
c) The risk and the burden of proof for the correct and timely exercise of the right of withdrawal rests with the consumer.
d) The consumer bears the direct costs of returning the product. Unless Information Medicine BV indicates that it will bear the costs itself.
e) If the consumer makes use of his right of withdrawal, all additional agreements will be legally dissolved.

4.6. Wrong delivery or damaged products

a) We try to select and package our products as best as possible to ensure they arrive in good condition. However, if a product arrives damaged or defective, or if you’ve received something different from what you ordered, we will replace it free of charge or issue a full refund. The product must then be returned to us within 30 days of receipt at the address stated in article 9.
b) In these circumstances we will also pay you the cost of the return shipment. Please request proof of postage from your post office so that we can process the refund of your return shipping charges.
c) For questions concerning returning items later than 30 days after your initial purchase, please email us for more information.
d) These terms do not affect any of your legal rights.
e) The customer agrees to inspect his shipment upon delivery and to report any damage immediately within 5 days of delivery.
f) The customer agrees that Information Medicine BV is not liable for any damage if information and a photo of the damage are not provided to Information Medicine BV in writing within 5 days of delivery.

4.7. Obligations Information Medicine BV

a) If Information Medicine BV enables the notification of withdrawal by the consumer electronically, Information Medicine BV will immediately send a confirmation after receiving this notification.
b) Information Medicine BV will reimburse all payments made by the consumer, including any delivery costs charged by Information Medicine BV for the returned product, without delay but within 14 days following the day on which the consumer notifies him of the withdrawal. Unless Information Medicine BV offers to collect the product itself, it may wait
with repayment until it has received the product or until the consumer demonstrates that he has returned the product, whichever is earlier.
c) Information Medicine BV will use the same payment method for reimbursement as the one the consumer has used for the initial payment, unless the consumer agrees to another method. The refund is free of charge for the consumer.
d) If the consumer has opted for a more expensive method of delivery than the cheapest standard delivery, Information Medicine BV does not have to reimburse the extra costs for the more expensive method of payment.

5. Complaints, complements and feedback

5.1. Any complaint, complement or feedback about any of our products or services may be submitted by email, post or telephone. You will find our contact details in article 9 of these terms and conditions.
5.2. We aim to deal with your complaint, complement or feedback within five working days of the supposed day of receipt.
5.3. In the event that we are unable to resolve your complaint immediately, we will inform you within 14 working days of the steps we will take and the likely timetable of those steps.
5.4. If you provide ideas, suggestions or other feedback in connection with your use of the Information Medicine’s services, products or any content, such feedback is not confidential and may be used by us without restriction and without payment to you.
5.5. A consumer who is not acting in the course of his profession or business and who is a resident of the European Union can also lodge a complaint via the online alternative dispute resolution (ODR platform) platform. 6. Warranty conditions, repairs and warranty period

         6.1.  Warranty conditions

a) Information Medicine BV guarantees that the product is free from manufacturing and/or material defects, provided that:

i.   The product was sold directly to you through Information Medicine BV or by an authorized reseller.
ii.   Was delivered to you in new condition.
iii.  Was delivered in the original packaging.
iv.  That the product has been used under normal circumstances.

b) The invoice you receive from us after placing and paying for your order is also your proof of warranty. So keep it well. If you have lost the invoice, you can find in your personal dashboard under the heading invoices. If you do not have an account with us, please contact our customer service at contact@informationmedicine.org.

c) Within the warranty period, the Information Speaker will be repaired free of charge or replaced for the same or an equivalent product if repair is not possible. No shipping costs are charged when warranty applies.

d)If an order is delivered visibly damaged by the relevant delivery service, refuse to accept it and do not sign for receipt. The product will automatically be returned to us and we will arrange for the delivery of a new one.

e) There are a number of situations that are not covered by our warranty, namely:

i.     Damage or defects due to falling, impact or made intentionally.
ii.    Defects due to improper use, for example connecting the speaker incorrectly or a blown speaker, etc.
iii.   Normal wear and tear from use.
iv.   Defects due to unauthorized third-party modifications and repairs.
v.    Moisture, water and fire damage.
vi.   Damage or malfunction due to lightning strikes and electromagnetic induction due to lightning.

f) If you have problems with an Information Speaker that you bought second-hand, defects are not covered by the warranty, but in that case you can always contact us at contact@informationmedicine.org so that we can see if we can still provide a solution.

 6.2.   Repairs

a) It is of course very inconvenient if a product you have purchased from us becomes defective or does not function properly (anymore). In that case, please contact our customer service at contact@informationmedicine.org. Our customer service will advise you on the procedure to follow. If the product needs to be shipped, please do so preferably in the original packaging. Always include a copy of the invoice (your proof of purchase) and an accurate description of the complaint.

  6.3.   Warranty period

a)  When purchasing a product you always have a legal guarantee. If you buy a product, you may assume that it is a sound product and that you can use it for the purpose for which it is intended. If a product does not function properly, you are entitled to free repair, a new product or a refund. What you can expect from a product depends on the type of product, which is why there is no general legal warranty period in the Netherlands. However, within European law there is a fixed guarantee period.

i.     In accordance with European law, we provide a 24-month warranty on our Information Speaker, starting on the day of purchase as  stated on the invoice.
ii.    If there is a defect in the product within 6 months after purchase, the burden of proof regarding the soundness of the product lies  with us, the seller.
iii.   If there is a defect in the product after 6 months after purchase, then the burden of proof regarding the soundness of the product            iv.   Note: Please note that the Information Speaker is not drop or impact resistant. Fall and impact damage is therefore not covered by     the warranty. For more information about the warranty of our products, please refer to our warranty conditions.

7. Warranty disclaimers and limitation of liability

7.1. You indemnify and hold harmless Information Medicine BV and its officers, directors, employees, agents and affiliates etc., from and against all claims, disputes, demands, liabilities, damages, losses and costs and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in in any way related to (i) your access to or use of our services, products or content or (ii) your violation of these terms.
7.2. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraudulent misrepresentation or any other liability which may not otherwise be limited or excluded by law in the Netherlands.
7.3. We make no representation or warranty of any kind, express or implied, statutory or otherwise, with respect to the content of the website.
7.4. We do not warrant that the website or the server that makes it available is free of viruses. We will not be responsible or liable to you for any loss of any kind resulting from any action taken in reliance on any material or information on the website.
7.5. Neither Information Medicine BV nor any other party involved in creating, producing or providing the services, products or content shall be liable for any incidental, special, exemplary or consequential damages, including, but not limited to, lost profits, loss of data or goodwill, interruption computer damage or system failure or the cost of replacement services or products arising out of or in connection with these terms or from the use of or inability to use the services, products or content, whether based on warranty, contract , tort (including negligence), product liability or any other legal theory, and whether or not Information Medicine BV has been advised of the possibility of such damages, even if it is determined that any limited remedy described herein has failed to meet its essential goal has been met. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.
7.6. In no event shall Information Medicine BV’s liability arising out of or in connection with these terms and conditions or from the use or inability to use our services, products or content exceed the amounts paid by you. Or fifty euros (€50), if you have no payment obligations towards Information Medicine BV.
7.7. Any advice or recommendation given by Information Medicine BV or its employees or agents to the customer or its employees or agents with respect to the storage, application or use of Information Medicine’s website services and products, which is not (i) confirmed in writing in any contract or (ii) agreed between the parties in writing by way of amendment to any contract and these terms and conditions are followed or followed entirely at the customer’s own risk and accordingly Information Medicine BV shall not be liable for any such advice or recommendation not so confirmed.
7.8. We will not be liable, in contract or tort (including, but not limited to, negligence), except where we have been fraudulent or negligent in misrepresentation.
7.9. The exclusion and limitation of damages as set out above are fundamental elements of the basis of the agreement between Information Medicine BV and the customer. This clause does not affect your statutory rights as a consumer, nor your right to cancel contracts, under Dutch law.

8. Force Majeure

8.1. We will not be liable or deemed to be in breach of contract for any delay in the performance or failure to perform any of our obligations where such delay or failure is due to any cause beyond our reasonable control, and in such circumstances, we are entitled to a reasonable extension of time to perform such obligations. Without limiting the generality of the foregoing, the following shall be deemed to be causes beyond our reasonable control:
a) Force majeure, explosion, flood, storm, fire or accident; war or threat of war, sabotage, insurrection, riot or claim; a pandemic; acts, restrictions, regulations, ordinances, prohibitions or measures of any kind on the part of any governmental, parliamentary or local government; import or export regulations or embargoes; strikes, lockouts or other industrial action or trade disputes (both with employees of Information Medicine BV and with a third party); difficulties in obtaining raw materials, labor, fuel, parts or machinery; power failure or equipment failure, material breach of contract or other default of our suppliers or subcontractors. If such circumstances make it impossible for us to deliver all or part of the ordered items within a reasonable period of time, the customer’s liability is limited to the value of the items already delivered plus the associated reasonable shipping costs.

9. Final Provision and Jurisdiction

9.1. All agreements between you and Information Medicine BV are governed by Dutch law. All disputes between the parties arising from the erms and Conditions and all agreements and obligations arising therefrom will be settled exclusively by the competent court in the Netherlands. Nothing in these Terms and Conditions shall be deemed to affect your statutory rights under the laws of the Netherlands.
9.2. Insofar as not dictated otherwise by mandatory law, all disputes that may arise as a result of the agreement will be submitted to the competent Dutch court in the district where Information Medicine BV is located.
9.3. If at any time any term or provision of these Terms and Conditions is found to be illegal, invalid or unenforceable in whole or in part, under any law or provision, that term or provision or any part shall be deemed not to form part of these terms, but the enforceability of the remainder of these Terms will not be affected.
9.4. Information Medicine’s failure to enforce any right or provision of these Terms and Conditions shall not be deemed a waiver of such right or provision. The waiver of any such right or provision shall be effective only if in writing and signed by a duly authorized representative of Information Medicine BV. Except as expressly set forth in these terms, the exercise by either party of any of its remedies under these terms shall not prejudice its other remedies under these terms or otherwise.
9.5. You may not assign or transfer any of your respective rights or obligations under these Terms and Conditions to a third party without the prior written consent of Information Medicine. Any attempt by you to assign or transfer these Terms, without such consent, will be void and of no effect.
9.6. Information Medicine BV may freely assign or transfer its respective rights and obligations under these Terms and Conditions in whole or in part to any third party without restriction. Subject to the foregoing, these terms are binding for the benefit of the parties, their successors and permitted assigns.
