1. General

a) Content: For the purposes of these Terms “Content” means text, graphics, graphic files, music, sound files, software, audio, video, works of any kind, including information or other material posted, generated, provided or otherwise made available through our website or services. In brief; everything you can see or hear that is made by us, Information Medicine BV.
b) User Content: Information provided by users of our website and services. That means any content that users (including you) make available to us through our website(s) or services. Content includes without limitation User Content.

You acknowledge that our services, products and content are protected by copyright, trademark and other applicable Dutch or International laws. You agree not to remove, alter or obscure any copyrights, trademarks, service marks or other proprietary rights contained in or with our services, products or content.
4. Intellectual property rights
a) You acquire the rights of use as set forth in these Terms, conditioned on your compliance with your obligations under these Terms. Without prejudice to any rights or remedies of Information Medicine BV under the law of these terms, any failure to comply with these terms will give Information Medicine BV the right to deny or terminate your access to the website services.
b) All rights not expressly granted to you in these terms of use are reserved by Information Medicine BV.
c) Information Medicine BV reserves all rights, titles and interests in and to our content, services and products including, but not limited to, all copyrights, trademarks, trade secrets, trade names, proprietary rights, patents, title, codes, audiovisual effects, themes, characters, stories, settings, illustrations, sound file works and moral rights, all applications thereof and all other intellectual property rights in all materials and/or content made available as part of your use of this website remain our property at all times.
d) These terms do not grant you any right to use our Brand Features, whether for commercial or non-commercial use.
e) Subject to your compliance with these terms, Information Medicine BV grants you a limited, non-exclusive, non-transferable, non-sublicensable license to stream, view, play and display our content solely in connection with your permitted use of our services and/or or products as defined in your subscription.
f) The audio files are only made available via live streaming and are not sold or transferred to you.
g) You acknowledge and agree that the material and content on this website is made available only for your personal, non-commercial use and that you may stream such material and content only for the purpose of using this website.
h) Healthcare professionals may use our services, products and content as defined in their professional subscription.
i) You agree that you will not redistribute or transfer the Information Medicine BV services or content. You further acknowledge that any other use of the contents of this website is strictly prohibited and you agree not to infringe or permit others to infringe on our intellectual property.
j) Unless permitted by binding rules, you shall not, without Information Medicine BV’s prior written consent:
i. Commercially exploit the content, services and/or products such as the sound files and Information Speakers;
ii. distribute, lease, license, sell, rent, lend, transfer or otherwise assign the content, website services and/or products, copies thereof or passwords or usernames associated with the website services;
iii. copy, reproduce or distribute the content, services or products in any way or through any medium or in any way decompile, disassemble or reverse engineer the same;
iv. make the website services available to the public or over a network for streaming or downloading by multiple users;
v. remove, alter or obscure product information, copyrights, intellectual property, copyright notices, legal notices or other labels of the origin or source of the content, website services and/or products;
vi. modify, improve or create derivative works from the content, website services and/or products.
5. Prohibitions
You agree not to do any of the following:
a) Post, upload, publish, submit or transmit any Content that: (i) infringes, or violates our patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or any publicity or privacy rights; (ii) violate or encourage any conduct that would violate any applicable law or regulation or give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, vulgar or abusive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any person or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any person or entity; or (vii) promotes illegal or harmful activities or substances;
b) use, display, mirror, or frame our services, or any individual element within our services, Information Medicine BV’s name, trademarks, logos, or other Information Medicine BV’s proprietary information, or the layout and design of any page or form on one page, without the express written consent of Information Medicine BV;
c) access, tamper with, or use non-public portions of the services, Information Medicine BV’s computer systems, or Information Medicine BV’s providers’ technical delivery systems;
d) attempt to identify the vulnerability of an Information Medicine BV e.g. to examine, scan or test. Violate any system or network or security or authentication measures;
e) avoid, circumvent, delete, disable, harm, decipher, or otherwise circumvent any Information Medicine BV’s e.g. implemented technological measure or one of Information Medicine BV’s suppliers or other third party (including another user) to protect our services;
f) attempt to access or search our services or download content from our services using any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools, and the like) other than the software and/or search agents provided by Information Medicine BV or other publicly available third-party web browsers;
g) send unsolicited or unauthorized advertising, promotional materials, e-mail, junk mail, spam, chain letters or other solicitations;
h) use meta tags or other hidden text or metadata using any Information Medicine trademark, logo URL, or product name without the express written consent of Information Medicine BV;
i) use our services for any commercial purpose or the benefit of any third party or in any way not permitted by these terms;
j) forge any TCP/IP packet header or any portion of the header information in an email or newsgroup posting, or in any way use our services to transmit altered, deceptive, or false source-identifying information;
k) attempt to decipher, decompile, disassemble or reverse engineer the software used to provide our services;
l) interfere with or attempt to interfere with any user’s, host or network’s access, including, but not limited to, virus transmission, overload, flooding, spamming or bombing of our services;
m) collect or store personally identifiable information from the Services of other users of our services without their express consent;
n) impersonate or misrepresent your affiliation with any person or entity;
o) violate any applicable law or regulation;
p) or encourage or enable another person to do any of the foregoing.
We have the right to investigate violations of these terms or conduct affecting our services. We may also consult and cooperate with law enforcement authorities to prosecute users who violate the law.
